90 DAYS MONEY BACK GUARANTEE WITH KITCHENAID COOKWARE (AUSTRALIA ONLY)

Terms and Conditions

The following terms and conditions apply to the “90-Day Money Back Guarantee” promotion (“Promotion”) organized by The Cookware Company Australia Pty Ltd., ABN: 11639575054, located Level 21, 55 Collins Street, Melbourne Victoria 3000, Australia, (“The Cookware Company“).

The Promotion entails that you can test the participating products for 90 days as of the purchase date. If you are not satisfied with the Product (as defined below), you are entitled to return the Product and receive a refund for the purchase price in accordance with these terms and conditions.

Conditions

  1. Eligible products – The Promotion is valid for every pan purchased from the KitchenAid Classic Stainless Steel and Cast Iron Collection (“Products”) from June 9th to July 13th, 2025 (“Promotion Period”), at Myer (both online and in Myer stores) (“Retailer”).
  2. Only one refund request can be submitted per purchased Product.
  3. The refund will consist of the purchase price of the relevant Product. Under no circumstances will the original delivery cost or gift-wrapping fee be refunded. The return cost will be borne by The Cookware Company.
  4. Returns requested under this promotion will only be processed in accordance with these terms and conditions by The Cookware Company, and not by Myer
  5. The Promotion is only valid for end consumers residing in Australia during the Promotion Period.

Procedure for refund

  1. If you wish to participate in the Promotion, you must purchase a participating Product during the Promotion Period. If you are not satisfied with the Product, you must contact The Cookware Company’s Customer Care via https://support.kitchenaidtools.com/ (with a valid request as set out in point 7 below) no later than 11:59pm AEST October 11th, 2025 after the date of your purchase as shown on your tax invoice, provided that the purchase/order date is during the Promotion Period. Products purchased after 11:59pm AEST July 13th, 2025, will not be eligible for a refund.
  2. A valid request includes:
    • Your contact information (name and address).
    • The bank account number where you wish to receive the refund.
    • Tax Invoice or eligible Proof of purchase (stating purchase date & amount and Product information); and Clear photo of the Product.
    • Original packaging with all components and accessories
  1. The Cookware Company will process and verify your request within 10 days of receipt and will provide you with the necessary instructions for the return of the Product. If your request is deemed valid by The Cookware Company, you will receive a refund to the Australian bank account number provided within 30 days of receipt of the returned Product. The refund can only be issued to an Australian bank account and will be processed within this timeframe, provided that all required information has been correctly submitted by you.

 

General Information

  1. These Terms and Conditions do not exclude or limit the application of any statutory provision (including a provision of the Competition and Consumer Act 2010 (Cth) where to do so would contravene that statute or cause any part of these Terms and Conditions to be void.
  2. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under any other similar consumer protection laws in the States and Territories of Australia. Except for any liability that cannot by law be excluded, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
  3. In case of technical or logistical problems during the Promotion, The Cookware Company will attempt to resolve the issue as soon as possible to the best of its ability. The Cookware Company is in no way obligated to extend the duration of the Promotion.
  4. The Cookware Company is not responsible for the availability of the Products at the Retailer. If the Products are not in stock during the period of the Promotion, there is no right to participate in the Promotion after this period.
  5. The Cookware Company reserves the right to amend these terms and conditions without any right to compensation or alternative action, in any form whatsoever.
  6. The Cookware Company cannot be held liable for any incorrect information communicated by the Retailer regarding this Promotion.
  7. The Cookware Company cannot be held liable for any incorrect information and/or data provided by the participant.
  8. The Cookware Company reserves the right, at any time, to verify the validity of claims and claimants (including a claimant’s identity, age and place of residence) and to disqualify any claimant who submits a claim that is not in accordance with these Conditions or who tampers with the claiming process
  9. The Cookware Company is entitled to investigate the documents submitted by the participant for fraud at any time. In case of strong suspicion of fraud, The Cookware Company may refuse the participant’s return The Promoter’s decision on all matters pertaining to the promotion is final and binding and no correspondence will be entered into.
  10. The personal data provided by the participant, such as name and financial details, will only be used for processing the refund request and in line with our Privacy Policy please see under Terms and Conditions). This information will not be shared with third parties, except when required by law or necessary for processing your request and refund.

  1. If any provision of these terms is deemed invalid or unenforceable for any reason, this shall not affect the remaining provisions. The terms shall be interpreted as if such invalid or unenforceable provision(s) had never been included.
  2. These terms and conditions and any dispute or claim arising out of or in connection with these terms and conditions, their subject matter, or formation, shall be governed by the law applying in Victoria. Each party irrevocably agrees that the courts of Victoria shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with this agreement, its subject matter, or formation.
